Legal basis is the Decree Law No. 556 on the protection of the trademarks of November 5th, 1995 (last amended January 28th, 2009 by The Law on Amendment of the Decree Law no. 556 no. 5833).Turkey is a member of the Madrid Protocol. Trademark protection is obtained by registration.

Requirements:

  • The name, address, nationality and occupation of the applicant and the nature of its business.
  • A list of the goods/services and the classes pertaining thereto.

     
  • A soft copy of the trademark in JPEG format.
  • A simply signed Power of Attorney.
  • A certified copy of the priority document, which can be submitted within three months from the date of filing, in the case that it is claimed.

Procedure:

  • A trademark application has to be filed before the National Patent Office (TPE) by a local agent. 
  • The application process includes a formal examination, an examination of distinctiveness and a search for prior trademarks. 
  • After registration the trademark application is published in the monthly “Resmi Markalar Bülteni”. 
  • The opposition period is 3 months from publication date of the application.
  • It takes approximately 10-12 months from first filing to registration.

Duration and Renewal: A trademark registration in Turkey is valid for 10 years and starts with registration date.The registration is renewable for periods of 10 years.
