Legal basis is the Trade Marks Ordinance revised Edition showing the law as of August 31, 2009. In Turks & Caicos Islands, one can apply to register a trademark in either of two ways: based upon a UK registration or independently within the local system.

Requirements:

  • Name, nationality, profession and address of the applicant.
  • Details of the trademark owner (name, address, registration number).
  • Design of the trademark in JPEG format in case of a graphical trademark (not required for word mark).
  • The details of goods and/or services for which the trademark will be registered or the classes in case they are known.
  • A non-legalized power of attorney is sufficient.

Procedure:

  • A trademark application has to be filed before the trademarks registry in Grand Turk by a local agent.
  • The application process includes a formal examination, an examination of distinctiveness and a search for prior trademarks.
  • After formal examination and acceptance, the mark is published in the weekly Gazette for opposition.
  • An opposition must be filed within 1 month of the date of publication.
  • It takes approximately 9-12 months from first filing to registration.

Duration and Renewal: A trademark registration in Turks and Caicos Islands is valid for 10 years and starts with registration date. The registration is renewable for periods of 10 years.
