Tajikistan

Legal basis is the Trademark Act of March 5, 2007.Tajikistan is a member of the Madrid Agreement. From June 30, 2011, Tajikistan is a member of the Madrid Protocol as well.Trademark protection is obtained by registration.

Requirements:

  • Details of the trademark owner (name, address, registration number).
  • Design of the trademark in JPEG format in case of a graphical trademark (not required for word mark).
  • The list of goods and/or services for which the trademark will be registered. 
  • A non-legalized power of attorney is sufficient.

Procedure:

  • A trademark application has to be filed before the Patent Office by a local agent.
  • The application process includes a formal examination, an examination of distinctiveness and a search for prior trademarks.
  • After a formal examination , your trademark will be published in the Patent Office Gazette to allow third parties to oppose it if they believe that your mark infringes on theirs. You will receive status updates as soon as your mark is published and will be notified of any actions taken.
  • There is no opposition period for pending application.The non-official opposition may be filed during the whole term of examination before issuance of the decision to grant a certificate on the trademark in Tajikistan.
  • The processing time from first filing to registration is approximately 16-25 months.

Duration and Renewal: A trademark registration in Tajikistan is valid for 10 years and starts with registration date. The registration is renewable for periods of 10 years.
