Legal basis is the new Trademark Law in force since December 24th, 2009 with the amendments in force as of February 7, 2013.Serbia is a member of the Madrid Agreement and the Madrid Protocol.

Requirements:

  • Details of the trademark owner (name, address, registration number).
  • Design of the trademark in JPEG format in case of a graphical trademark (not required for word mark).
  • The list of goods and/or services for which the trademark will be registered. 
  • A non-legalized power of attorney is sufficient. Foreign applicants do not need a domestic registration.

Procedure:

  • A trademark application has to be filed before the Intellectual Property Office of the Republic of Serbia by a local agent.
  • The application process includes a formal examination, an examination of distinctiveness and a search for prior trademarks.
  • I After registration, the trademark is published in the two-monthly “Glasnik intelektualne svojine”.
  • In Serbia there are no national provisions for filing opposition against a pending trademark application
  • If no objection by a 3rd party, a registration certificate will be issued.
  • It takes approximately 3-6 months from first filing to registration.

Duration and Renewal: A trademark registration in Serbia is valid for 10 years and starts with registration date. The registration is renewable for periods of 10 years.
