Malta

Legal basis is the Trademarks Act of January 1st, 2001.Since May 1st, 2004, Malta has been a member of the European Union. Malta is not a member of the Madrid Agreement or Protocol.

 Requirements:

  • The applicant's name and address;
  • The trademark details;
  • A detailed description of the goods / services falling within the class(es) according to the International Classification of Goods and Services;
  • Prints of the trademark (not needed for word marks);
  • The Power of attorney notarised.
  • If for Claim of Priority:country, date and application number of the first application; Copies of the priority documentation of the first application from the Comptroller of Industrial Property (in case the priorty documentation is not in English a translation is required);

Procedure:

  • The application is filed at the Industrial Property Registrations Directorate. 
  • The application process includes a formal examination, an examination of distinctiveness and a search for prior trademarks.
  • Once the trademark application is filed and the formalities are fulfilled the application is then checked for the substantive requirements by the Malta IPO. 
  • Upon registration, the trademark is published in the “Malta Government Gazette” for the opposition.
  • If no opposition, the mark is then registered and certificate issued. 
  • The processing time from first filing to registration or first office action is approx. 9 months.

Duration and Renewal: A trademark registration is valid for 10 years from the date of filing. The registration is renewable for periods of 10 years each.
